The use of any product, service, collateral, or feature (the “Materials”) available through the website located at www.printspack.in (the “Website”) by any user (“User,” “You,” “Your”) is governed by these Terms of Use.

By accessing or using the Website, placing an order, or downloading Materials, you agree to these Terms of Use. If you do not agree, please refrain from using the Website or engaging our services. In case of a conflict with area-specific terms posted elsewhere on the Website, such specific terms will prevail.

1. Corporate Identity and Legal Status
PrintsPack is a online brand of printing and packaging solutions, operating under the legally registered parent entity Printing Solution (Registered GSTIN: 09AEIPV4004K1Z7). Printing Solution is a legitimate, compliant commercial entity, secured and governed under the statutory laws of the Government of India.

2. Manufacturing, Printing, and Quality Tolerances
Due to the technical nature of custom manufacturing, printing, and packaging (whether manufactured directly or outsourced), the following conditions apply and are accepted by the User upon placing an order:

• Color Variations: Digital screens display colors in RGB, whereas commercial printing utilizes CMYK processes. Consequently, slight color variations between the digital proof and the final physical product are a standard industry occurrence and do not constitute a defect.

• Quantity Tolerances: Due to the physical mechanics of printing and die-cutting, a variance of up to 20% (shortage or excess) in the final delivered quantity is considered an acceptable industry standard. In the event of a shortage, billing will be adjusted accordingly; however, this cannot be grounds for order cancellation.

• Structural Variations: The flaps of the boxes or specific folding elements may be inverted or slightly altered to ensure structural integrity and accommodate the manufacturing mechanics of the packaging collateral.

3. Returns, Refunds, and Dispute Resolution
As all PrintsPack products are custom-manufactured to the User’s specific requirements, all Delivered Materials are strictly non-returnable and non-refundable.

• Under the Sale of Goods Act, 1930 (Section 16), there is no implied warranty or condition as to the quality or fitness for any particular purpose of goods supplied, especially for bespoke orders approved by the buyer.

• Positive Resolution Protocol: PrintsPack values its clients. In the event of genuine dissatisfaction regarding manufacturing defects, the recipient is encouraged to reach out to the PrintsPack support team. We are committed to working toward a mutually positive and fair resolution, provided the claim is raised within a reasonable timeframe.

4. Client Conduct and Zero-Tolerance Communication Policy
PrintsPack maintains a strictly professional working environment. Any use of threats, abusive, aggressive, or derogatory language directed at PrintsPack, its employees, or affiliates by the client or recipient will result in immediate action:

• The offending User/Client will be permanently blocked.

• All ongoing communication, requests, and processing of resolutions or refunds will be immediately terminated.

• Such behavior constitutes a material breach of contract and may invite legal action under the Indian Penal Code (IPC) (concerning criminal intimidation and intentional insult) and the Information Technology Act, 2000.

5. Statutory Protections and Payment Defaults (Indian Law)
PrintsPack is fully protected under Indian commercial law.

• MSMED Act, 2006: For B2B transactions, delayed payments beyond the agreed-upon credit period are subject to compound interest at three times the bank rate notified by the Reserve Bank of India, as strictly enforced by the Micro, Small and Medium Enterprises Development Act.

• Indian Contract Act, 1872 (Section 73): PrintsPack reserves the right to claim compensation for any loss or damage caused by a client’s breach of contract, including sudden cancellations of custom orders already in production.

6. Limited License & Intellectual Property
PrintsPack grants you a non-exclusive, non-transferable, limited copyright license to access and view this Website, provided that you do not remove any proprietary notices or attempt to interrupt the Website’s operation. You may not mirror, copy, modify, distribute, or create derivative works from the Materials on this Website. Violation of these terms will result in automatic termination of your rights.

7. User-Generated Content & Feedback
Users may submit comments or feedback at PrintsPack’s discretion. By contributing content, you agree not to defame, harass, or abuse any party; upload infringing, obscene, or unlawful content; embed viruses; or perform actions that damage the Website. PrintsPack may monitor, edit, or remove user-generated content and pursue legal remedies for violations.

8. No Warranties & Limitation of Liability
All Materials are provided “as is” without express or implied warranties. PrintsPack does not warrant that the Website will be error-free or uninterrupted. Under Section 56 of the Indian Contract Act, 1872 (Doctrine of Frustration), PrintsPack shall not be held liable for any delay or failure in performance or delivery resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including but not limited to raw material shortages, machinery breakdowns, labor disputes, or government restrictions.

10. Governing Law & Jurisdiction
These Terms of Use are governed by the laws of India. Exclusive jurisdiction and venue for any dispute shall lie with the competent courts in Ghaziabad, Uttar Pradesh, India, and you submit to the personal jurisdiction of such courts under the Code of Civil Procedure, 1908. Any legal claim must be initiated within one (1) year from the date of the cause of action.

11. Entire Agreement
These Terms of Use constitute the entire agreement between Printing Solution (PrintsPack) and you regarding your use of this Website and services. No amendments or waivers are valid unless in writing and signed by an authorized representative of PrintsPack.
